Three justices led by the Deputy chief justice Alifonse Owinyi Dolo have overturned the high court decision and declared Ocen who stood as an independent as the validly elected member of parliament.
In their unanimous judgement, the justices ruled that the petitioner Ebil did not plead the necessary and material  particulars which is unlawful.
On the 16th of August 2016, the high court in Kampala  presided over by justice Wilson Masalu Musene had thrown Ocen out of parliament after his rival and also former area MP Fred Ebil  from UPC accused Ocen of electoral malpractices including use of sectarian language, voter bribery and using government vehicles during campaigns.
