The much awaited hearing of the murder case against Kawempe North MP Muhammad Ssegirinya and Makindye West MP Allan has flopped before the International Crimes Division of the High Court.

Hearing was expected today before justice Alice Komuhangi,  however, Defense Lawyers led by Shamim Malende raised objections including the fact that prosecution up to now has failed to reveal all their intended evidence against their clients to help them prepare their defense.

Malende further submitted before Court that Kigogo Prisons has denied them to meet the MPs to sign on their Constitutional Petition Challenging their separate trials and withholding of some evidence and witnesses protection.

She explained that everytime they travel to Kigo to meet their clients, they are denied access to them by the Prison Authorities under the pretext of Ebola, which has frustrated their preparations.

This forced justice Komuhangi to adjourn the matter to the 5th of December 2022.

Meanwhile,  Lawyer Malende has advised state prosecutor Richard Birivumbuka to stay in his lane as a prosecutor instead of behaving like an investigator.

This is after some accused persons including a one Kanyike Jackson, confessed that he was forced to implicate the NUP MPs over the said offences, while Sserwada Mike told court that he was arrested for violating the Covid-19 curfew hours.

Shamim revealed that some suspects have revealed that Birivumbuka has been going around kigo prison with other police officers to forcefully make statements to implicate Ssegirinya and Sewanyana at gun point  which is unprofessional.

Malende says that this shows that the state has no evidence against the suspects and that ad the defense team, they will see that Justice prevails for their clients.

Birivumbuka meanwhile informed court that he was receiving threatening messages for prosecuting the said case, however, Malende advised him to have a thick skin since she was also threatened before and advised him to report the matter to police if the threats are legitimate.
