Updates: Bobi Wine granted bail

Bobi Wine has been granted a one million cash bail. sureties ordered to pay 10M non cash. Magistrate has barred him from participating in unlawful procession. If he participates in any procession his bail will automatically be nullified.

Meanwhile Hon. Kyagulanyi Robert aka Bobi Wine has once again been given a chance to a dress court after grade one magistrate Esther Nahirya concluded hearing his bail application.

In his own words Bobiwine say "I thank you for this opportunity to address court. It is not we on trial but the court. Whatever you decide isn't my business. My business is the truth, what is morally right.

If standing for what is right is going to keep me in this prison, so be it. After all I have a lot of work to do, even here in prison".

Leader of opposition has criticized reasons cited by state while objecting to the bail application of Kyadondo East MP Robert Kyagulanyi aka Bobiwine.

This is after state prosecutor Timothy Francis Amerit told court that sureties like Hon.Miria Matembe are insubstantial since she is of advanced age of 64 and not capable to feasibly compel Bobiwine to adhere to court orders.

However, the leader of Opposition says that its ironical that the State recently just amended the constitution and lifted the presidential age limit to allow even a person of over 100 years to rule the country yet,the state is objecting a person of 64 years to stand surety.

She says that she is not happy with the away the judge has handled the bail application including allowing the state prosecutor to take more than one hour saying completely rubbish.

Other opposition politicians like Allan Sewanyana have criticized what they called a move bu the judiciary to impose the video link conferencing for his bail application.

Ssewanyana says that the judiciary has violated the procedures of the video conferencing since it the suspect who requests it through its lawyers but instead, the judiciary imposed it on him without allowing him to give his opinion on whether he wanted his application to be heard via a video link.

Bobiwine has become the first person to have his case tried via the new technology that was launched bu the chief justice Bart Katureebe on the 15th of April 2019.

State says Hon.Kyagulanyi should be denied bail because his sureties are not substantial.

State prosecutor Timothy Francis Amerit has told court that one of the Surety Hon. Miria Matembe is of advanced age of 64 and there she is not feasibly capable to compel Bobi Wine to adhere to court orders.

Amerit has also objected to the two MPs on grounds that the two are MPs are equals to Bobi Wine and as a result has no legitimate authority over him including forcing him to return before court.

He says that sureties must have powers to force the accused person to adhere to court orders but not merely tell him.

He also says that Bobiwine has no constitutional right to bail but only to apply for bail and that court can either grant it or not.

He also says the three sureties and BobiWine have no fixed place of abode within the court jurisdiction since they reside out of Kampala.

He however has advised court that in case court grants Hon.Kyagulanyi bail it should be a 10 million cash bail but not a non cash bail as his lawyers had requested.

He has also told court that the charges against Bobi Wine are not of political persecution since he is charged with disobeying statutory duties.

Lawyers representing Kyadondo East jailed legislator led bu Asuman Basalirwa have asked Buganda road court grade one magistrate Esther Nahirya to grant Hon.Kyagulanyi a non cash bail.

Basalirwa says his client willingly subjected himself to the legal process and that he is neither on criminal summons or warrant of arrest but because court wanted him to be there and he obliged.

Basalirwa also says the charges preferred against Kyagulanyi don't involve any violence because the main reason he was arrested even the state realized its significance and revised the OTT tax which means he was on the right cause for everyone including state.

He adds that Hon .Kyagulanyi is a peaceful man and has never been convicted of any offense under any courts of law and that through his music career, he has been helping police to fight crime.

He adds that Hon.Kyagulanyi is a family man with four children and a young wife and that he is not a flight risk because he is an MP representing people of Kyadondo East on top of being a sole bread winner for his tender family.

However, state is objecting to Hon.Kyagulanyi's bail application

Asuman Basalirwa has also presented three sureties including Hon.Miria Matembe whom he said is a personal friend of Bobiwine in the struggle,42 year old Member of Parliament for Kasambya county Hon.Mbwa Tekamwa Gaffa and Hon.Nsamba Patrick of Kasanda East who is Bobiwine's neighbor and also a colleague.

Kyadondo East MP Robert Kyagulanyi will not be physically in court for his bail application this morning.

The application will be heard through a video conferencing system in which Buganda road court grade one magistrate Esther Nahirya will sit at Buganda road court while Bobi wine will be at Luzira prison.

Meanwhile this has left his Supporters puzzled because they expected to see him physically in court.

These are now dissatisfied saying the movie is biased since Bobi wine is not a charged with a capital offense.

It is also believed that if he is granted bail, he will be driven by security operatives straight to his home.

Some of the key personalities who are in court include Musician Hilderman, oppostion politicians Sulaiman Kidandala, Latif Sebagala, Allan Sewanyana among others.

On the 15th of April this year, the Chief Justice, Bart Katureebe,commissioned a video conferencing system to Luzira Maximum Security Prison and Buganda Road court.

Justice Katureebe called upon all judges and other stakeholders to see that the system is used to serve its purpose.

He said that if fully used by judges to serve its purpose, they will see that the system is enrolled in all courts starting from the smallest (grade one courts) to the highest court (Supreme court).

The facility will be used for the mentioning of criminal cases before they are fixed for trial.

He says that the program is going to save suspects and Luzira prison officials the burden of coming to court even for short sessions like mentioning of case as it has been the case.

Supporters of Bobiwine are stranded at court as the judiciary decides to hear his bail application through video conferencing.

This means that Bobi wine will not be brought to court but Buganda road court grade one magistrate Esther Nahirya will hear it with Hon.Kyagulanyi at Luzira prison premises.

It is also believed that if he is granted bail, he will be driven by security operatives straight to his home.

There is tight security and heavy deployment in Kampala as Kyadondo East MP Robert Kyagulanyi ak Bobi wine is expected to return today before Buganda road court for his bail application.

UPDF soldiers have been deployed in surrounding areas including Kiseka Market and all roads leading to Buganda road court have been blocked and being heavily guarded by both UPDF soldiers and the Uganda police.

At the court entrance some members of the public with no proper identification have been bared from accessing court premises and only a handful of people are being allowed to access court.

Meanwhile a few supporters of Bobi wine who have been cleared by security to access court are anxiously waiting for him in the court corridors waiting for him to be produced in court.

Some of these include former deputy Lord Mayor Sulaiman Kidandala, his loyal bodyguard Eddie Mutwe among others

Buy for now Bobi wine has not arrived.
