KANANURA JUDGEMENT PUSHED TO FRIDAY THIS WEEK

By Sania Babirye

The High court has adjourned the judgement in which rally car driver Andrew Desh Kananura and four others are charged with the murder of Badru Katerega.  Badru was a bar attendant at Panamera bar found in Naguru.

The judgement was supposed to be delivered this afternoon by high court judge Joseph Murangira but was indisposed of. It will be delivered on Friday 28th April 2017.

On the 18th of April 2017, two court assessors Robert and Kabuleeta and Babirye Rehema advised justice Mulangira to have Desh acquitted of the murder charge on grounds that prosecution witnesses gave inconsistent and contradictory evidence against Desh and his three co-accused persons.

The  accessors say the evidence  pinned only one suspect   Jacob Onyango the security guard who was found to be  at  scene of crime when Katerega was bitten to death.

The court accessors are mere members of the society who are chosen by court to follow the case and give their unbinding opinion with no legal training to the judge who might regard or disregard it.

In March 2017 Kanunura preferred to give unsworn in evidence as he began his defense and was not cross examined over his defense by state.

In his defense Kananura denied killing Badru Katerega saying that, on that fateful night he was called from his home by his night watchmen only know as Charles and Robert. They further stated that the victim was juried and as they were calling for the ambulance. Desh was later informed that Badru had passed on.

Desh is jointly charged with his brother Raymond Kananura and 3 of their private guards with the murder of Badru Kateregga was an attendant at his Panamera bar located in Naguru a Kampala suburb .

Prosecution says the 5 with malice fore thought on the 30th of September 2012 beat Katerrega to death for allegedly receiving a tip of shs 10000 from a bar client.

Desh and his co-accused are currently out on bail.
